XCXCortex

Terms of Service

Effective September 29, 2026 · Version 1.0

The short version

This summary isn't the whole agreement. Please read the terms below.

1. This agreement

These Terms are an agreement between you and XCortex (“XCortex”, “we”, “us”). XCortex is operated by an individual based in California, United States. The Terms cover your use of the XCortex website, app and related services (the “Service”). By creating an account, using the Playground or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you don't agree, please don't use the Service.

2. Who can use XCortex

You must be at least 13 years old. If you're under 18, or under the age of majority or digital consent where you live, you may use XCortex only with the permission of a parent or guardian who agrees to these Terms for you. You can't use XCortex if the law prohibits it or if we've previously banned you.

3. Accounts

4. The Playground

You can try XCortex without an account in the Playground. A Playground is a temporary account with a sample day. It is deleted automatically after about 24 hours unless you choose Keep it and create an account, which keeps what you made. The Playground has limits:

Don't put anything in a Playground you'd mind losing. These Terms apply to Playground use too.

5. Your content

You own your content: the tasks, notes, goals and anything else you put into XCortex. You give us a limited, non-exclusive, worldwide, royalty-free permission to store, process, copy and display it, and to send it to the providers described in our Privacy Policy, only to provide, secure and improve the Service for you. This permission ends when you delete your content or account, except for copies in backups, which age out on their normal schedule.

We don't sell your content, don't use it for advertising, and don't use it to train AI models. You're responsible for your content and for having the right to put it into XCortex, for example when your notes include other people's information.

Keep your own copies of anything important. You can download all your data at any time from Settings → Download my data.

6. AI features

7. Connected services and your own keys

You can connect services such as your own AI provider, a Telegram bot, calendar feeds, web search and tool servers (MCP). When you do:

We're not responsible for third-party services or their availability.

8. Reminders and notifications

We work hard to deliver reminders on time. But delivery depends on things outside our control: your device, browser and settings, notification services, Telegram, and the internet. Reminders can be late or missed. Don't rely on XCortex as the only reminder for anything where missing it could cause harm, such as medication, safety, legal deadlines or critical appointments. Weather and travel-time details come from third parties and may be unavailable or wrong.

9. Plans, trials and billing

10. Acceptable use

Don't use XCortex to:

11. Our service and feedback

XCortex, its software, design and name belong to us and our licensors. These Terms don't give you any rights to them beyond using the Service. If you send us feedback or ideas, we may use them freely, with no obligation to you.

12. Changes to XCortex and to these Terms

XCortex is evolving. We may add, change or remove features. If we remove something significant from a paid plan during your billing period, we'll offer a fair remedy such as a pro-rated refund.

We may update these Terms. We'll post changes here with a new date, and give you notice in the app or by email at least 14 days before significant changes take effect. If you keep using XCortex after changes take effect, you're agreeing to them. If you don't agree, stop using XCortex and delete your account.

13. Suspension and termination

You can stop using XCortex at any time, and delete your account yourself in Settings → Delete account. Deleting your account cancels any paid subscription at the same moment, so you aren't charged again.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or others. Where reasonable, we'll tell you first and give you a chance to fix things and to export your content. If we discontinue XCortex entirely, we'll give you at least 30 days' notice and a way to export your content, and refund any unused prepaid period.

Sections 5 (the last paragraph), 11 and 14–18 continue after these Terms end.

14. Disclaimers

XCortex is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free, secure, or that data will never be lost. AI output and third-party information (such as weather and travel times) are provided without warranty. Some places don't allow these disclaimers, so they apply to you only as far as the law allows.

15. Limitation of liability

To the fullest extent the law allows, XCortex won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or opportunities, arising from or related to the Service or these Terms. Our total liability for all claims related to the Service is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) US $50.

These limits don't apply where the law doesn't allow them, such as liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence. If you're a consumer in the EU or UK, nothing in these Terms limits your statutory rights.

16. Indemnity

If you use XCortex for business purposes, you'll defend and compensate us against claims, losses and costs (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your violation of the law or others' rights.

17. Governing law and disputes

These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules.

Please contact us first. Most issues can be solved by email, and we'll try in good faith for 30 days. If that doesn't work:

If you're a consumer living outside the US, you may also have the right to bring proceedings in your home country's courts and to rely on its mandatory consumer protections. Nothing here takes those away.
